TRUETALKS PRIVACY POLICY

Truecaller International LLP incorporated and operating under the laws of India with LLP identification number AAK-3926 and registered office at Studio 04A109, WeWork, Platina Tower, Mehrauli- Gurgaon Road, Gurugram, 122002 India, provides services accessible through its online community platform “TRUETALKS” (“Services”) and is the controller of your personal information under applicable data protection laws.

 

Truecaller International LLP will be referred to as the “Company” or “we” or “our” or “us”. 

 

This Privacy Policy together with the Terms of Service and the Community Guidelines explains how we handle your personal information. Please read this Privacy Policy carefully to understand how we will treat your personal information. 

 

For the purposes of this Privacy Policy, personal information is any information that identifies, relates to, describes, directly or indirectly, with you. Personal information does not include information that is anonymous, aggregated, or de-identified. Please also note that we do not sell any of your personal information. 

 

  1. Personal information we may collect

 

When you interact with our Services, we may collect the categories of personal information below. 

 

Account and user profile. We collect your Community Display Name and e-mail address to create your user account and profile. You can choose to add your photo, an avatar photo and your birthday information to your profile. We show information about when you joined the Services and “last visited” on your profile. 

 

Submitted content. We collect the content you submit to the Services. This includes your posts, comments and status updates including saved drafts, polls, your messages with other users and your reports and other communications with moderators and with us. Your content may include text, links, images, gifs, audio, videos, software, and tools.

 

Actions you take. We collect information about the actions you take when using the Services. This includes your interactions with the platform and content, such as your likes, quotes and reporting. It also includes your interactions with other users, such as your following, ignored and visited users. We collect your interactions with forums and clubs, like your subscriptions or moderator status.

 

Customer support and other information. If you contact our customer support team, we will receive your email address, as well as the information you send to us to help resolve your query. You may also provide us with various information in connection with your interaction with our Services (e.g., if you decide to participate in surveys etc.). 

 

Device and connection information.  We collect information about your device such as device manufacturer and type; IP-adress, approximate location, browser and operating system.

 

Log and event information.  When you use our Services, we collect log and event information on how our Services are accessed and whether the user is already authenticated or not (user logged in or not) as well as metadata related to your activity on the Services such as how many people were in the conversation and the length of it. We also collect performance logs, diagnostics, bugs, and crash reports and log files. 

 

  1. How we use your personal information

 

We use personal information for the following purposes: 

 

  1. Provide our Services. We use your information to create and maintain your account; to improve and develop the Services and the Services’ features; to communicate with you about the Services by sending you push notifications with announcements, updates, security alerts, and other administrative messages depending on your settings.
     

  2. Compliance and security.  We use your information to comply with applicable laws; respond to requests from government authorities; verify user accounts and activity; ensure Services functionality, safety and data accuracy, investigate suspicious activity; perform troubleshooting activities; prevent and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft fraud; protect our, your, or others’ rights, privacy, safety or property (including by making and defending legal claims) and enforce the Terms of Service and the Community Guidelines that govern the Services.

 

  1. Support and maintenance. We use your information to provide customer support, respond to your queries, investigate and resolve issues related to the Services; improve, fix, and customize our Services; understand how you use our Services; analyze and use the information to evaluate and improve our Services, business and operations, and research, develop and test new services and features.

 

  1. Statistical data. We may create and use aggregated, de-identified, or anonymized information to analyze the effectiveness of our Services, to improve and add features to our Services. We also use third party analytics services to understand and analyze the general behaviour and characteristics of users of our Services and share such data with third parties. 

 

  1. Whom we may disclose your personal information to

 

We may share your personal information, where it is lawful to do so, with:

  • other users subject to your Services settings;

  • our group companies, affiliates or successors, and third parties who propose to acquire all or part of business or operations, whether such acquisition is by way of investment, merger, restructuring, sale of capital or assets, by operation of law, or otherwise;

  • third party service providers such as providing VoIP services, hosting and maintenance, data storage and management, and marketing and promotions, technical infrastructure services, bug testing, analysing how our Services are used, measuring the effectiveness of Services as well as potential partners who may wish to work with us to provide other services;

  • law enforcement agencies, regulators, government departments if we have a legal obligation to do so; and

  • professional advisors, such as lawyers, accountants, auditors and/or consultants.

 

  1. Data retention

 

We keep your personal information for as long as you are a registered user to fulfill the purposes we collected it for. To protect the safety and security of our users, your personal information may be retained for a reasonable period following account deletion in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. After that we will either anonymise your personal information, or we will ensure that it is deleted in accordance with our records retention practices and procedures.

 

  1. Data security

 

We take all reasonable precautions to protect personal information from misuse, loss and unauthorized access. Truecaller has implemented physical, electronic, and procedural safeguards in order to protect the information, including that the information will be stored on secured servers and protected by secured networks to which access is limited to a few authorized employees and personnel. However, no method of transmission over the Internet or method of electronic storage is 100% secure.

 

  1. International transfers

 

In order to provide the Services, we will transfer, process and store personal information in a number of countries, including but not limited to India, and may also use cloud based services for this purpose. We may also subcontract storage or processing of your information to third parties located in countries other than your home country. Information collected within one country may, for example, be transferred to and processed in another country, which may not provide the same level of protection for personal data as the country in which it was collected. You acknowledge and agree that we may transfer your personal information as described above for purposes consistent with this Privacy Policy. 

 

  1. Third-party information and services 

 

You may use our Services in connection with third-party services. In order for the Services to interoperate with such third-party services, we may receive information from them about you or we may share your information with them. For example, you may also use such third party services to create your user profile or log in to our Services, share information with such third party services, or to connect your user profile with the respective third party services. Such third party services may automatically provide us with access to certain personal information retained by them about you and you agree that we may collect, use and retain the information provided by these third party services in accordance with this Privacy Policy. We never store any passwords created for third party services. Your use of third-party services is governed by the terms and privacy policies of such services. You may control the information you allow us to have access to through the settings on the respective third party service. 

 

The Services may contain links to websites and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites or online services operated by third parties, and we are not responsible for their actions.

 

  1. Minors

 

Our Services are not intended for or designed to attract or be used by anyone under the relevant age of consent to enter into binding legal contracts under the laws of their respective jurisdictions. We do not intentionally or knowingly collect personal information through our Services from anyone under that age. We encourage parents and supervising adults to be involved in the online activities of their children to ensure that no personal information is collected from a child without their consent. 

 

  1. Changes to this privacy policy

 

We may update this Privacy Policy from time to time in response to changing legal, technical or business developments. If we make material changes, we will notify you by push notification and/or posting it on the Services. The effective date set forth at the top of this document indicates when this Privacy Policy was last changed.
